  • Other copyrightable or otherwise protected materials.

Nothing on cykels.com should be interpreted as transferring ownership of intellectual property to a website visitor or customer.

2. Permitted Use

Customers may access and use cykels.com for lawful personal shopping and informational purposes.

You may view website content and use ordinary website functions necessary to browse products, place orders, obtain customer support, or otherwise interact with Cykels.

Unless authorized by the applicable rights holder or permitted by law, you may not:

  • Reproduce protected content for commercial purposes.
  • Republish website content.
  • Sell or license website content.
  • Copy product photography for commercial use.
  • Remove copyright, trademark, or ownership notices.
  • Present protected content as your own.
  • Use protected branding in a misleading manner.
  • Create unauthorized commercial materials based on protected website content.

3. Third-Party Intellectual Property

Certain names, trademarks, logos, images, technologies, or other materials appearing on cykels.com may belong to third parties.

Third-party intellectual property remains the property of its respective owner.

The appearance of third-party trademarks or materials on our website does not transfer ownership of those rights to Cykels or to website users.

4. Respect for Intellectual Property Rights

Cykels does not knowingly intend to offer or publish content that unlawfully infringes valid intellectual property rights.

If you believe content available through cykels.com infringes a copyright, trademark, or another legally protected intellectual property right that you own or are authorized to enforce, you may submit a claim for review.

We ask rights holders to provide sufficient and accurate information so that the allegedly infringing material and the claimed rights can be reasonably identified.

5. How to Submit an Intellectual Property Claim

Send your claim to:

support@cykels.com

Please use a clear subject line such as:

Intellectual Property Claim – [Name of Rights Holder]

Your notice should include the information described below.

6. Rights Holder Information

Please provide:

  • Full legal name of the rights holder.
  • Your full name if you are submitting the claim on behalf of another person or organization.
  • Company or organization name, if applicable.
  • Email address.
  • Mailing address.
  • Telephone number, if available.
  • Your relationship to the rights holder if you are acting as an authorized representative.

If you are acting on behalf of another rights holder, you should be authorized to submit the claim.

7. Identification of the Intellectual Property

Clearly identify the intellectual property that you believe is being infringed.

Depending on the type of claim, this may include:

  • Copyrighted work.
  • Trademark.
  • Registered design.
  • Original photograph.
  • Original artwork.
  • Written content.
  • Logo.
  • Other legally protected material.

Please provide enough information for us to understand and identify the claimed right.

Where applicable, include:

  • Registration number.
  • Registration jurisdiction.
  • Registration date.
  • Official registration record or reference.
  • Original publication or source.
  • Other evidence demonstrating ownership or authorization.

A registration number is not required where the applicable right does not require registration, but sufficient evidence should be provided to support the claim.

8. Identification of the Allegedly Infringing Material

Your notice should identify the specific material on cykels.com that you believe infringes your rights.

Please provide:

  • The exact page or product involved.
  • The applicable page URL, if available.
  • Product name, if applicable.
  • Description of the material.
  • Screenshot, if helpful.
  • Explanation of why you believe the material infringes your rights.

A general statement that the website contains infringing material without identifying the specific material may not provide enough information for us to investigate the claim.

9. Statement of Good-Faith Belief

Please include a statement confirming that you have a good-faith belief that the disputed use is not authorized by:

  • The intellectual property owner.
  • An authorized representative.
  • A valid license.
  • Applicable law.

10. Accuracy and Authority Statement

Please include a statement confirming that:

  • The information in your notice is accurate to the best of your knowledge.
  • You are the owner of the intellectual property right or are authorized to act on behalf of the owner.

For copyright notices submitted under applicable U.S. copyright procedures, additional declarations may be required by law.

11. Signature

Please include your physical or electronic signature.

Typing your full legal name at the end of an electronic notice may serve as an electronic signature where legally sufficient.

12. Claim Review Process

After receiving a sufficiently complete claim, Cykels may:

  • Review the information provided.
  • Identify the material at issue.
  • Review the claimed intellectual property right.
  • Request additional documentation where reasonably necessary.
  • Review relevant ownership, licensing, or authorization information.
  • Take appropriate action based on the circumstances and applicable law.

Submission of a claim does not automatically establish infringement.

We may need additional information before determining the appropriate response.

13. Possible Actions

Depending on the circumstances and applicable law, we may take actions such as:

  • Removing content.
  • Temporarily restricting access to content.
  • Correcting content.
  • Requesting additional evidence.
  • Contacting the relevant content provider or rights holder.
  • Taking no removal action if the available information does not reasonably establish infringement.
  • Taking other action required by applicable law.

Where appropriate, content may be restored if a claim is withdrawn, resolved, or successfully challenged under an applicable legal process.

14. Incomplete Claims

A claim may be incomplete if it does not sufficiently identify:

  • The claimant.
  • The intellectual property right.
  • The allegedly infringing material.
  • The location of the material.
  • The basis of the claim.
  • The claimant's authority.

If additional information is required, we may request clarification before completing our review.

15. Trademark Claims

For trademark-related claims, please provide information such as:

  • Trademark owner.
  • Trademark name or representation.
  • Registration number, if registered.
  • Registration jurisdiction.
  • Goods or services covered by the trademark.
  • Location of the allegedly infringing use.
  • Explanation of the alleged infringement.
  • Supporting documentation.

Trademark rights can depend on jurisdiction, registration, goods and services, and manner of use. Claims will therefore be reviewed based on the specific circumstances presented.

16. Copyright Claims

If your claim concerns copyright infringement, identify:

  • The copyrighted work.
  • The copyright owner.
  • The allegedly infringing material.
  • Where the material appears on cykels.com.
  • Your contact information.
  • Your authority to submit the notice.
  • Any statements or signature required by applicable copyright law.

Copyright claims intended to constitute a formal notice under the U.S. Digital Millennium Copyright Act should follow the requirements described in our separate DMCA Policy.

17. Counter-Notices and Disputed Claims

Where applicable law provides a counter-notification procedure, a person whose content has been removed may be entitled to challenge the removal.

We will process legally valid notices and counter-notices according to applicable requirements.

A dispute between competing rights holders may require resolution directly between the parties or through an appropriate legal process.

18. False or Misleading Claims

Do not knowingly submit false, fraudulent, or materially misleading intellectual property claims.

A person who knowingly misrepresents that material infringes intellectual property rights may be responsible for consequences available under applicable law.

Claimants should carefully verify ownership, authorization, and the basis of their claim before submitting a notice.

19. Repeat Infringement

Where appropriate and applicable, Cykels may take reasonable action concerning repeated infringement associated with website content, accounts, suppliers, or other relevant parties.

Actions will depend on the circumstances and applicable legal requirements.

20. Product and Brand References

References to third-party brand names, trademarks, products, or services, where present, are not intended to imply ownership by Cykels unless expressly stated.

All third-party trademarks remain the property of their respective owners.

21. No Transfer of Rights

Purchasing a product from Cykels does not transfer intellectual property rights in:

  • Product photographs.
  • Website graphics.
  • Brand assets.
  • Marketing materials.
  • Website content.
  • Protected designs or artwork.

Customers receive ownership of the physical product purchased, subject to applicable law, but do not automatically receive intellectual property rights associated with protected content or branding.

22. Privacy of Claim Information

Information submitted in connection with an intellectual property claim may be used to:

  • Review the claim.
  • Verify ownership or authorization.
  • Communicate with the claimant.
  • Communicate with relevant parties.
  • Maintain records.
  • Meet applicable legal obligations.
  • Establish, exercise, or defend legal rights.

Information will be handled in accordance with our Privacy Policy and applicable law.

Where legally necessary, certain information contained in a claim may be disclosed to another party involved in the dispute.

23. Legal Rights and Remedies

Nothing in this policy limits any intellectual property right, defense, exception, limitation, or remedy available under applicable law.

This policy provides a process for submitting claims to Cykels and does not constitute a determination of legal ownership or infringement.

24. Changes to This Policy

We may update this Intellectual Property Rights & Claim Policy when reasonably necessary to reflect changes in:

  • Website practices.
  • Claim procedures.
  • Business operations.
  • Applicable intellectual property laws.

The current version will be published on cykels.com with its applicable effective or updated date.
